Basically, in this research, which was prepared and organized using a descriptive-analytical method, the main question and objective of examining this issue was that in the event of an accident in the country's railway transport network, which institution and individuals will be responsible for civil liability and compensation for damage. In this regard, the results and findings of the research confirm that the elements of imposing civil liability are achieved by committing an act leading to a railway accident, incurring losses resulting from a railway accident, and ultimately the causal relationship between the occurrence of a harmful act and incurring losses in a railway accident, and depending on the case, liability will be imposed on the government or the Ministry of Roads, private companies, the transport operator, or the wrongdoers.</p> <p>در ذیل نظام و ساختار حاکم بر مسئولیت مدنی، بخشی از تحمیل مسئولیت همواره به واسطه بروز سوانح و حوادث انجام می&zwnj;گیرد که به طور اختصاصی، توجه این پژوهش به ارکان تحمیل مسئولیت مدنی ناشی از سوانح و حوادث ریلی و نهادها و اشخاص مسئول در قبال آن متمرکز است. اساساً در این تحقیق که به روش توصیفی &ndash; تحلیلی تهیه و تنظیم شده است پرسش و هدف اصلی بررسی این موضوع بوده است که در صورت رخداد سانحه در شبکه حمل و نقل ریلی کشور، مسئولیت مدنی و جبران خسارت بر عهده چه نهاد و اشخاصی خواهد بود. در این خصوص نتایج و یافتههای تحقیق موید این مطلب است که ارکان تحمیل مسئولیت مدنی با ارتکاب فعل منجر به سانحه ریلی، ورود ضرر ناشی از سانحه ریلی و نهایتاً رابطه سببیت بین وقوع فعل زیانبار با ورود ضرر در سانحه ریلی محقق می&zwnj;شود و حسب مورد مسئولیت بر دولت یا وزارت راه، شرکت&zwnj;های خصوصی، متصدی حمل و نقل یا اشخاص خاطی تحمیل خواهد شد.</p> http://akhlagh.saminatech.ir/fa/Article/Download/52708
