مرکز منطقه ای اطلاع رسانی علوم و فناوری فصلنامه پژوهش‌های اخلاقی (انجمن معارف اسلامی ایران) 2383-3279 16 3 2026 3 14 Investigating the impact of ethics in the establishment of legal rules بررسی تاثیر علم اخلاق در تاسیس قواعد حقوق 25 49 fa هرمز اسدی کوه باد دانشیار، گروه حقوق، واحد رامهرمز، دانشگاه آزاد اسلامی، رامهرمز ، ایران 2025 2 13 <p>One of the most important topics in the basics of science is the impact that knowledge has on other sciences; Morality is the science of a set of characteristics that with special methods; Man should be adorned with them or refrain from them, since the humanity of man is to beautify and adorn himself with them, therefore this science has a high place among human knowledge and dealing with it is one of the undeniable necessities that all human schools have to They admit that; From this process, sciences and occupations have become "superior" to achieve their goals, and scientific ethics, professional ethics, medical ethics, etc. have emerged, the science of law in the theoretical foundations and construction of rules and in the implementation stage It is morally dependent.This article has investigated this issue in an analytical and descriptive way and has reached these results: that ethics and law both have a common goal and goal with distinction in subject and territory, because both are for the order and moderation of individual and social life, with the difference that The science of ethics seeks to institutionalize traits that achieve inner justice by adorning virtues and abandoning vices, and laws with special rules and guarantees of special executions, give these two precious gems "justice and order" in the outside world; Therefore, legal systems are influenced and originated from moral rules.</p> <p>یکی از مهمترین مباحث در مبادی علوم، تاثیری است که آن دانش، در سائر علوم دارد؛ اخلاق، علم به مجموعه ای از ویژگی هایی است که با روشهای خاص؛ انسان باید به آنها آراسته یا از آنها خوددداری نماید، از آنجا که انسانیت انسان به آراستن و پیراستن خود به آنهاست، لذا این علم در میان معارف بشری جایگاه والایی داشته و پرداختن به آن از ضروریات غیر قابل انکاری است که همه ی مکاتب بشری به آن اذعان دارند؛ ازاین روهمه ی علوم ومشاغل برای نیل به غایت خود «مضاف الیه» آن واقع شده&zwnj;اند و اخلاق علمی، اخلاق حرفه ای، اخلاق پزشکی، و... پدید آمده است، علم حقوق در مبانی نظری و ساخت قواعد و در مرحله&zwnj;ی اجراء، براحکام اخلاقی متکی است. این مقاله به روش تحلیلی و توصیفی، این مهم مورد بررسی و به این نتایج دست یافته است؛ که اخلاق وحقوق هردو با تمایز درموضوع و قلمرو ، هدف وغایتی مشترک دارند، زیرا هر دو برای انتظام واعتدال زندگی فردی واجتماعی اند؛ با این تفاوت که علم اخلاق درپی نهادینه کردن صفاتی است که با آراستن به فضیلت ها و ترک رذیلت ها عدالت درونی را متحقق می نماید و حقوق با قواعد خاص وبا ضمانت اجراها ی ویژه، این دو گوهر گرانبها «عدالت و نظم» را درعالم بیرون دست می دهد؛ لذا نظامهای حقوقی از قواعد اخلاقی متاثر و نشات گرفته است.</p>
