Aiming to present a model of citizenship rights from the perspective of Islamic jurisprudence, this research first analyzes the fundamental concepts of citizenship, human dignity, justice, and mutual duties of the government and the people in jurisprudential sources. Then, by examining the religious evidence&mdash;including the Quran, the Sunnah, jurisprudential rules, and the governance practices of the infallibles&mdash;indicators and principles such as the right to life, security, freedom, social and political participation, property, fair trial, and equality before the law are extracted. The research findings show that Islamic jurisprudence, by emphasizing the inherent value of man and the rule of negation, can provide a coherent framework for citizenship rights that is compatible with contemporary human rights standards on the one hand and preserves the Islamic identity of the legal system on the other.Finally, the research presents a proposed model of citizenship rights based on jurisprudence, which is a combination of normative principles, executive mechanisms, and requirements of just governance. This research uses a descriptive-analytical method. The research findings show that despite the newness of the term citizenship, its conceptual dimensions and the necessity of its protection have been considered and emphasized by the legislator in Islamic teachings.</p> <p>مفهوم حقوق شهروندی در جوامع اسلامی، افزون بر مبانی عرفی و حقوقی، ریشه&zwnj;ای عمیق در آموزه&zwnj;های فقهی دارد. این پژوهش با هدف ارائه&zwnj;ی الگوی حقوق شهروندی از منظر فقه اسلامی، ابتدا به تحلیل مفاهیم بنیادین شهروندی، کرامت انسان، عدالت و تکالیف متقابل حکومت و مردم در منابع فقهی می&zwnj;پردازد. سپس با بررسی ادله&zwnj;ی شرعی- including قرآن، سنت، قواعد فقهی و سیره&zwnj;ی حکومتی معصومان - شاخص&zwnj;ها و اصولی همچون حق حیات، امنیت، آزادی، مشارکت اجتماعی و سیاسی، مالکیت، دادرسی عادلانه و برابری در برابر قانون استخراج می&zwnj;شود. یافته&zwnj;های تحقیق نشان می&zwnj;دهد که فقه اسلامی با تأکید بر ارزش ذاتی انسان و قاعده نفی&zwnj;سبیل، می&zwnj;تواند چارچوبی منسجم برای حقوق شهروندی ارائه دهد که از یک سو با معیارهای معاصر حقوق بشر قابل تطبیق است و از سوی دیگر، هویت اسلامی نظام حقوقی را حفظ می&zwnj;کند. در پایان، پژوهش الگوی پیشنهادی حقوق شهروندی مبتنی بر فقه را ارائه می&zwnj;کند که ترکیبی از اصول هنجاری، سازوکارهای اجرایی و الزامات حکمرانی عادلانه است. در این تحقیق از روش توصیفی تحلیلی استفاده شده است. یافته های تحقیق نشان داده است که به رغم نوظهور بودن اصطلاح شهروندی، ابعاد مفهومی و ضرورت پاسداشت آن، در آموزه های اسلامی موردتوجه و تأکید شارع قرار گرفته است.</p> http://akhlagh.saminatech.ir/ar/Article/Download/53698
