Abstract :
The existence of different dimensions of corruption in different areas of governance in any society is an unavoidable fact that governments are trying to prevent its spread. One of the important manifestations and indicators of corruption in political societies, especially in societies that are not developed or are developing, is the concept of "rent and rent-seeking". Rent-seeking every day It shows its wide and diverse form. People who turn to such behavior and actions are victims of the conditions in which they have lived and are caught in a social trap. The most important factors that can be considered as the basis of behaviors mixed with corruption are: economic bottlenecks, dimming of human values. , the tightening of unnecessary rules and regulations and the expansion of the spirit of human indulgence that causes others to play inside slow In our legal system, due to the dependence of legal rules on Islamic Sharia, it is very necessary to examine the nature of rent-seeking in jurisprudence. It is spread and propagated in different parts of the society and plays a very important role in distorting justice and the significant expansion of all types of corruption. In jurisprudential sources, the term rent-seeking is not mentioned in this sense, but under general headings such as the need for justice and negation of discrimination, the sanctity of all wealth, and illegal possession of the treasury, and specific headings such as hoarding and bribery, owners and examples. It has been shown that the nature of rent-seeking and the conditions of its sanctity can be clarified in the foundations and sources of jurisprudence. In the present research, like most researches in the field of humanities, it is analytical-descriptive with library tools, with the aim of knowing the phenomenon of rent-seeking and the conflict of its moral indicators, whose manifestations can be seen in the country both in the private sector and in the public sector. is, has been used.

چکیده
وجود ابعاد مختلف فساد در عرصههای مختلف حکمرانی در هر جامعهای امری غیرقابل چشمپوشی است که دولتها درصدد جلوگیری از شیوع آن هستند. یکی از جلوههای مهم و شاخص فساد در جوامع سیاسی مخصوصا در جوامعی که توسعه نیافته و یا در حال توسعهاند، مفهوم «رانت و رانتخواری» است. رانت خواری هر روز به شکل گسترده و متنوعی خود را نمایان میسازد. افرادی که به چنین رفتار و کنشی روی میآورند قربانی شرایطی هستند که در آن تجربه زیسته دارند و گرفتار تله اجتماعی گشته‌اند.مهمترین عواملی که میتواند زمینهساز رفتارهای آمیخته با فساد تلقی می شود عبارتند از: تنگناهای اقتصادی، کمرنگ شدن ارزشهای انسانی، تشدید قوانین و مقررات غیر ضروری و گسترش روحیه زیاده خواهی انسانها که باعث می شود دیگران را به بازی داخل کند. در نظام حقوقی ما، با توجه به ابتنای قواعد حقوقی بر شرع اسلامی، بسیار ضرورت دارد که ماهیت رانتخواری در فقه نیز بررسی شود.رانت خواری عملی که عموماً همراه با تبعیض قائل شدن و کسب منافع نامشروع است، و به مثابه ویروسی کشنده در شئون مختلف جامعه منتشر و تکثیر میشود و نقش بسیار مهمی در مخدوش نمودن عدالت و گسترش چشمگیر انواع فساد دارد. در منابع فقهی طبعاً به اصطلاح رانتخواری به این معنا اشاره ای نشده است، بلکه تحت عناوین کلی نظیر لزوم عدالت و نفی تبعیض، حرمت اکل مال بباطل و تصرف غیرمشروع در بیتالمال، و عناوین جزیی نظیر احتکار و رشوه، مالکها و مصادیقی مطرح گردیده که میتوان ماهیت رانتخواری و شرایط حرمت آن را در مبانی و منابع فقهی روشن نمود. در تحقیق حاضر به مانند اکثر تحقیقات حوزه علوم انسانی تحلیلی-توصیفی با ابزار کتابخانهای میباشد که با هدف شناختن پدیده رانتخواری و تعارض شاخصهای اخلاقی آن که نمودهای آن در کشور هم در بخش خصوصی و هم در بخش دولتی قابل مشاهده است، استفاده شده است.
