In this study, the measures concerning the definition of the option of defect, the defect causing the option of defect, its legitimacy and the condition for the exclusion of defects in different sects of the Islamic jurisprudence of different religions have been considered, and various perspectives in different schools of jurisprudence have been analyzed. There is a controversy about the nature of clearance from the defects among the jurisprudents, while some, like Shafi'i consider that as an abstraction and as ownership and, some others consider it as the abolition of the right. In general, jurisprudents of different sects in the context of the condition of the transgression can be divided into two categories of believers and disbelievers. Believers led by the jurisprudence of Hanafi and Imami refer to Nosus and moral precepts of "Al-Momenoon based on their conditions" and the need the people find that innocence of the buyer counted as the defects that clears him. The disbelievers who make up most of the schools of jurisprudence, namely Shafe'i, Maliki, and Hanbali referring to the conditions of the contract liberation of the buyer from the defects does not excuse and clear him.
