The family institution has been mainstreamed in Islam in its introduction to the Convention on the Rights of the Child and has been introduced as the most important framework for the development of the child. When parental separation occurs, the issue of custody and priority of the parties arises for the care of the child, which is similar to the circumstances, in the absence of the necessary conditions for the custody to be transferred to the opposite party. At the same time, today one of the indicators of human development is the extent to which women are present and how they play their roles in various fields of activity, which has a serious impact on other actions. The issue of protecting women's rights and non-discrimination on the basis of gender is a special issue. Success in this case needs to be paid for employment that is being tackled. Education is one of the issues that has been paid special attention to religious and non-religious philosophies for a long time. It is important to study the Islamic-Iranian model for the development of human beings in the science of education. The Islamic-Iranian pattern is a theoretical model with normative function. This pattern can be presented in mathematical or logical language and it is necessary to use the methods of today's science to explain complex matters. Islamic-Iranian theory is a theory based on the principles of Islam's insight and within the framework of Islamic ethics and law and is in accordance with Iran's conditions. The study of Mulla Sadra's thoughts suggests that in the thought of Mulla Sadra, man has a vertical movement and flow in the levels of existence. Sadra's anthropology is the point of convergence between religious, ethical, philosophical and mystical anthropology, according to ontological and epistemological foundations, such as the originality of existence, the essential motion, etc., the comprehensiveness of man according to the different degrees and categories, which are the lowest Levels, ie, Jimdi, begin to the last stage, namely, immortality, rational thinking and rational perception. Social Security is one of the most important mechanisms for the realization of social justice. Iran's legal system, especially after the victory of the Islamic Revolution and the spread of slogans of justice and equality, and the elimination of all forms of discrimination and inequality, at least is in the pursuit of policies and programs to spread social justice through the social security mechanism in many constitutions and laws. The Islamic state of early Islam (Prophet's and Amir al-Momenin (pbuh) governments) views was based on establishing the principle of equality and non-discrimination in the welfare of Muslims. The Islamic State of Iran, whose constitution is regulated by the application of Islamic laws and principles, has also sought to establish the rules governing social security on the basis of principles such as the principle of equality and non-discrimination, and the legislator requires the Islamic state to interfere in its implementation and supervision. Therefore, social security laws in Iran, although as set out in its original objectives, have not been able to comply with the principles of Islamic laws, due to lack of resources and increased population, the efforts made represent the will of the Islamic State along the path to justice and equality in this category. In Islamic teachings, the process for selecting the right people is not directly expressed but there exist some overviews. In Islam, it is mentioned that the decision on hiring the employees should be fair and rational, and since the believers are more honest, employees should be obliged to Islamic beliefs such as praying, fasting, zakat and so on. The human resource manager should consider such criteria while hiring the needed employees. The current research is accomplished to develop Islamic indicators of recruiting human resources and to clarify the relations among its components by conducting an explorative mixed method. The first step was a qualitative study (Delphi analysis) in order to propose the research model, and the second one was the quantitative study. To this end, a sample size of 225 employees of a public organization was randomly selected for data gathering. Obtained data resulted in one main aspect, 10 components and 24 indicators based on which a questionnaire was developed and distributed. Findings of the second step validated the proposed model since the construct of "Islamic HR Recruitment" was statistically associated with its components and indicators. Manuscript profile

A saying from the Holley Prophet of Islam says: “praying has 70 parts, the best one is Halal earning”. Accordingly the real believers strongly value the professional banking morality for earning Halal income and from their point of view the bank which is based on Islamic morality must follow 6 important aims as will be described in the article such as executing economic justice in the society. As a result the idea of Islamic Banking was first made in the 1950s and the first Islamic investment banking was established in Egypt and Malaysia in the 1960s. There are over 100 kinds of Islamic banks and the law of banking without usury was passed and enforced in 1983 after Iran Islamic revolution. The theoretical, religious jurisprudence and Islamic morality related discussions among the people who are the users of this method of banking and among the bank clerks who enforce this methods, is yet to be answered and they are not fully justified that this method is right from the religious point of view, and the money taken and given is usury. We have tried to survey the activities of the banks focusing on monetary value of time and value of money during time in Islamic jurisprudence and find an appropriate answer. It is clear that the banks pay profit to customers when attracts their money and receives profit from them when loans them. These two issues happen during time and the method of paying and taking profit separates the way of Islamic banking from regular banking. Usury that is clearly forbidden in Islam takes place in elapse of time. We have used indisputable contracts in religious jurisprudence such as Salaf (buying in advance) and Nesiyeh (selling in advance) to differentiate these two with usury. Manuscript profile

The accepted criteria of criminalization are different in legal systems because in the process of criminalization, we are not faced with one principle and criteria, but several criteria and principles in turn play a role in the criminalization process. Therefore, in justifying the criminalization of a behavior, several criteria may be considered by the legislator, such as preserving human dignity, protecting moral values, denying harm, preserving fundamental interests, establishing social order and implementing criminal justice, etc. Dignity is not only a religious value but also as a universal human value that is deeply emphasized in religious teachings including the Qur'an and in the world arena in the first half of the twentieth century with the issuance of the Declaration. After the correct marriage and marital relations between the parties, various rights and duties are established, including financial rights between the spouses. Couples' financial rights are one of the most important parts of civil law, which is intertwined with customary and moral issues and is an important factor in crime prevention. Therefore, ignoring the role of custom and ethics in the rights of couples causes fundamental challenges in society. The purpose of writing this article is to explain the position of custom and ethics in some financial rights of couples, such as dowry, dowry and alimony from the perspective of Iranian law, Islamic religions and official religions in a descriptive analytical method; Explaining the limits of custom and introducing it, we will finally realize that although custom and ethics in the Iranian legal system, mainly in cases of text silence, have a complementary and interpretive role; But it has a role to play, and in many cases it is used practically in jurisprudence and law. Also, the role of custom in the Sunnah of Tabdan is Hadd, that what is considered acceptable in the custom is also considered acceptable in the sight of God. The role of custom in the rights of minorities (Jewish, Zoroastrian and Christian) is also undeniable according to their own religious customs and traditions, and is a source of rights. Adherence to ethical rules in the realm of the family plays a very decisive role in ensuring the rights of men and women all over the world; Because in many cases, the rights and obligations that couples assume towards each other have no legal obligation and are done solely on the basis of moral considerations. The purpose of the present research was to prove justice in the creative will and, accordingly, in the legislative will of God. This basic and theoretical research was done by analyzing data from the Holy Quran and Shia hadith sources. By analyzing the data, it was concluded that whether by rational method or by following the narration, the foundation of theoretical wisdom is based on the understanding of divine justice in development and based on the acceptance of this principle that values and prescriptions return to beings and non-beings. Therefore, the foundation of practical wisdom is based on theoretical wisdom. Therefore, the understanding of how divine justice flows in legislation is based on the understanding of moderation, both in the world of names and the levels of human worlds. On this basis and due to the correspondence of the perfect human being with the universe, a human being who is obliged to guide and lead others should be under the control of reason in perfect moderation of the powers of imagination and illusion and even senses, and no matter how successful he is in this matter. It can extend moderation to families, clans, and civilizations. As a result, the condition of any social reform act will be to accept the necessity of creating a reasonable moderation in youth and youth forces, as the creator of creation has manifested this moderation in his creation verses.
